Powers of Attorney
Property & Financial Affairs LPA
This allows you to choose someone who will ensure that all your property and financial affairs will be looked after. For example, operate your bank account, pay your bills, sort out your tax and decide what to do with your home. You can however impose restrictions: eg, preventing them from selling a second home, which you had left to a relative in a will.
Health & Welfare LPA
This allows you to choose someone to make decisions about your healthcare and welfare. This includes decisions to refuse or consent to treatment on your behalf or what medical treatment you are given; deciding where you live, what you eat and drink and even what you wear.
Will Trusts
Will Trusts are relatively similar to conventional Last Will & Testament’s. However, they are slightly more sophisticated providing additional practical benefits and additional financial benefits.
Will Trusts are recommended instead of Last Will & Testament's for anybody who owns their own home or has savings.
The legal facility provided by a Will Trust is extremely important for couples who have ex partners, children from previous relationships or former co-habitee's. Unlike a Last Will and Testament, a Will Trust offers protection from ex partners and children from previous relationships of the deceased, seeking to mount a legal challenge to the right of the surviving partner to remain living in the family home.
Asset Protection Trusts
A Will can only dispose of the assets that you own at the date of your death and if the value of these is eroded during your lifetime, there will be little if anything left for your beneficiaries to inherit.
Asset Protection Trusts are specifically designed to protect your assets for you during your lifetime. They give you the peace of mind that your estate can be passed on securely and intact to your spouse, your children and their bloodline, or other named beneficiaries, after your death.
Last Will & Testament
People assume that if they die without a Will their partner will inherit their Estate, this is not necessarily the case. If you die without a Will you will have died intestate. The Courts will effectively write your Will for you. They will demand that your Estate is distributed in accordance with their own strict rules. This can mean that your assets do not go to the people that you want to benefit, but instead they may go to the people you did not want to benefit.
If you die without a Will the probate process can be much longer, more complicated, more expensive and more distressing for the people you leave behind. This can leave your family with a financial and legal mess. One of your children or an ex partner could legally challenge your partners right to inherit your Estate.

What is Joint Tenancy?
A joint tenancy is a form of ownership by two or more individuals together. This form of ownership decrees that property will automatically pass to the survivor/s regardless of any instructions in their Will.
What is Tenants in Common?
A tenancy in common is another form of co-ownership the difference is that upon the death of one co-owner, his or her interest does not automatically pass to the surviving owner, but passes according to their Will.
